Excellent Marbella respects your privacy and processes your personal data in accordance with the General Data Protection Regulation (GDPR). In this privacy policy we explain which data we collect, why, and which rights you have.

2. Which personal data we process
- Contact details that you provide yourself via a form or WhatsApp: name, email address, telephone number and the content of your message.
- Interest/search data such as the property/properties or locations about which you request information.
- Technical data that is automatically recorded by our hosting provider (such as IP address, browser type and pages visited) for security and the proper functioning of the website.
3. Purposes & legal basis
We process your data exclusively for:
- handling your request and contacting you. Legal basis: your consent and/or taking pre-contractual measures at your request;
- improving and securing our website. Legal basis: legitimate interest;
- complying with legal obligations. Legal basis: legal obligation.
We never use your data for other purposes without your consent and we do not sell your data to third parties.
4. Cookies
We use functional cookies that are necessary for the website to work. In addition, only with your consent do we place analytical or marketing cookies. You make your choice via the cookie notice (accept, necessary only or decline) and can always change it by clearing the cookies/site data in your browser.
5. Recipients & processors
For the provision of our services we engage trusted third parties, who process data solely on our instructions:
- Resales-Online for the supply of the property listings (the properties shown);
- Vercel for the hosting of the website;
- Email/messaging services (including WhatsApp/Meta) for handling your requests.
Where necessary, data processing agreements have been concluded with these parties.
6. Transfer outside the EEA
Some of the above service providers may process data outside the European Economic Area (for example in the United States). In that case we ensure appropriate safeguards, such as the standard contractual clauses of the European Commission.
7. Retention period
We do not retain your data for longer than necessary for the purposes for which it was collected. Requests that do not lead to an agreement are kept for a maximum of 24 months, unless we are legally obliged to retain them longer.
8. Security
We take appropriate technical and organisational measures to protect your data against loss or unlawful processing, such as encrypted connections (HTTPS) and access restriction.
9. Your rights
You have the right to:
- access, correct or have your data deleted;
- restrict the processing or object to it;
- have your data transferred (data portability);
- withdraw any consent given at any time.
